Quetta, Nov 6: The Balochistan High Court (BHC) on Wednesday dismissed a petition challenging the election of Awami National Party (ANP) leader Aimal Wali Khan to the Senate from Balochistan, ruling that his nomination and election were in accordance with constitutional and legal provisions.
A two-member bench comprising Justice Muhammad Kamran Khan Mulakhail and Justice Gul Hassan Tareen announced the verdict, which effectively upheld Khan’s election to the upper house of Parliament on a general seat from Balochistan.
The petition, filed by advocates Muhammad Ali Kanrani and Hazrat Ali Kakar, had sought to annul Aimal Wali’s nomination and subsequent victory, arguing that he was neither a resident nor a registered voter of Balochistan and had obtained his voter registration “fraudulently.” The petitioners contended that this was in violation of Section 110 of the Elections Act, 2017, which governs eligibility and nomination procedures for parliamentary elections.

However, the court found no merit in the arguments presented, observing that the petitioners had failed to produce evidence showing that Khan’s voter registration or address had been unlawfully obtained.
Referring to Sections 26 and 27 of the Elections Act, the bench noted that an individual is considered a resident of a constituency where their Computerised National Identity Card (CNIC) lists a permanent or temporary address and where their name appears on the electoral roll.
“Accordingly, Aimal Wali Khan was fully qualified to contest the Senate election from Balochistan,” the court concluded, adding that his nomination papers had been accepted in line with the law.

Aimal Wali Khan, who serves as the provincial president of the ANP in Khyber Pakhtunkhwa, was elected to the Senate earlier this year. His nomination from Balochistan had sparked political debate, with critics questioning his connection to the province.
The BHC verdict is expected to put an end to the legal challenge over his Senate seat.
