Imran Khan, Bushra Bibi Sentenced to 17 Years in Toshakhana Case

RAWALPINDI: A special court of the Federal Investigation Agency (FIA) on Saturday sentenced Pakistan Tehreek-e-Insaf (PTI) founder and former prime minister Imran Khan and his wife, Bushra Bibi, to 17 years’ imprisonment each in the Toshakhana-2 case, which relates to the alleged unlawful purchase of state gifts.

The verdict was announced by Special Judge Central Shahrukh Arjumand during proceedings held at Adiala Jail, Rawalpindi, where Imran Khan is currently incarcerated. The case concerns the acquisition of an expensive Bulgari jewellery set from the Toshakhana at what the prosecution described as a substantially undervalued price.

According to the judgment, Imran Khan was sentenced to a total of 17 years in prison, comprising 10 years of rigorous imprisonment under Section 409 of the Pakistan Penal Code, which deals with criminal breach of trust, and seven years under Section 5(2)47 of the Prevention of Corruption Act for criminal misconduct by a public servant. Bushra Bibi received an identical sentence under the same legal provisions.

In addition to the prison terms, the court imposed fines of Rs16.4 million on each of the convicts. The judgment noted that failure to pay the fines would result in additional imprisonment in accordance with the law.

A copy of the court order stated that the judge had taken certain mitigating factors into account while awarding the sentence. “This court, while passing sentences, has considered the old age of Imran Ahmed Khan Niazi, as well as the fact that Bushra Imran Khan is a female. It is in consideration of both said factors that a lenient view has been taken in awarding lesser punishment,” the order read.

The court also granted the benefit of Section 382-B of the Criminal Procedure Code, which allows the period of detention already undergone by the convicts to be counted towards their sentences.

Following the announcement of the verdict, lawyers representing Imran Khan and Bushra Bibi stated that they would challenge the decision in the relevant high court. Legal experts note that appeals in such cases typically focus on both procedural and substantive aspects of the judgment.

The Toshakhana case has been one of several legal proceedings involving the former prime minister since his removal from office through a vote of no confidence in 2022. Imran Khan and Bushra Bibi were formally indicted in the Toshakhana-2 case in December last year after the completion of investigations by the FIA.

The sentencing is expected to have significant political and legal implications, particularly for the PTI, which has maintained that the cases against its founder are politically motivated, a claim consistently denied by the government and prosecution authorities.
