27th Amendment Challenged in Federal Shariat Court

Karachi, November 26, 2025 – In a bold legal move, a constitutional petition was filed on Wednesday before the Federal Shariat Court (FSC) seeking to strike down the recently enacted 27th Constitutional Amendment on the grounds that it violates core Islamic injunctions of justice, accountability, and judicial independence.
Barrister Ali Tahir, the petitioner, named the Ministry of Law and Justice and the Ministry of Parliamentary Affairs as respondents.

Key Arguments in the Petition

The lawyer contended that the amendment drastically shifts the balance of power in favour of the executive, undermines the independence of the judiciary, and entrenches military influence in constitutional matters — changes he described as “repugnant to the injunctions of Islam as laid down in the Holy Quran and Sunnah”.Barrister Tahir argued that Islamic governance demands:

  • Complete independence of the judiciary from executive and legislative control
  • Strict accountability of rulers and judges to Allah and the people
  • Equality before the law, with no privileged class enjoying lifetime immunity

He specifically criticised provisions granting lifetime immunity to the President and military leaders, calling them a direct violation of Quranic principles of equality and justice.

The petitioner urged the FSC to declare the 27th Amendment void and reaffirm the state’s continuing obligation to ensure all laws and institutions remain in harmony with Islamic teachings.
Legal circles are watching closely as this marks the first direct Shariat-based challenge to the controversial amendment since its passage last month.
